Terms of Service
The key points, in plain English. The full terms below are what legally apply.
- You pay 50% to start and 50% before launch. The deposit is not refundable once design work starts.
- Care plans are billed in advance. Your first month is always paid in full. After that, cancel or change your plan by telling us at least 30 days before your next billing date.
- Yearly care plans cost 20% less. They can be cancelled in the first 30 days (we keep one regular month); after that they are not refundable.
- You own your site once setup is paid in full. You are responsible for the content and photos you give us.
- Your domain name is not included in our prices. You pay for it separately, at cost. We recommend the best options and set it up.
- We do not guarantee Google rankings, traffic or sales.
- Our liability is limited to what you paid us in the 6 months before a claim, and we are not liable for lost profits.
- Disputes: talk to us first, then mediation, then the courts or Civil Resolution Tribunal of British Columbia.
1. Agreement
These terms apply when you hire Neox Websites ("Neox", "we", "us", "our") to build, host or maintain a website or provide related services. "You" or "the client" means the business that hires us and the person accepting on its behalf.
You accept these terms when you tick the agreement box on our contact form, sign or reply to accept a quote, pay a deposit or invoice, or ask us to start work, whichever comes first. You confirm that you are at least 18 and have authority to bind the business you represent. Electronic acceptance is as binding as a signature on paper.
Your written quote or order confirmation ("Quote") lists your plan, price, timeline and anything specific to your project. These terms and the Quote together form the agreement. If they disagree, the Quote wins for that project. Quotes are valid for 30 days.
Our services are offered to businesses, not for personal or household use.
2. Services and plans
We provide the setup and care plan you choose, as described in your Quote and on our pricing page on the day you order. Setup covers design, build and launch of your website. A care plan covers hosting management, domain renewal reminders and management, monitoring, support and the number of changes listed for your plan. Anything not listed is outside the agreed scope and is quoted separately before we start.
3. Prices, payment and refunds
- Prices are in Canadian dollars and do not include applicable taxes, which are added to invoices.
- Setup is paid 50% before work starts and 50% before launch. We do not publish the site until it is paid in full.
- The deposit is refundable only if you cancel before design work starts. After that it is not refundable. If you cancel after we share a preview, the second payment is not owed and we keep the deposit.
- Billing date. Care plans start on the day your site goes live (or the date in your Quote) and are billed in advance on that same date each month or each year ("billing date").
- Monthly care plans. The first month is a minimum term: it is paid in full and is not refundable. After the first month, you can cancel, downgrade or change your plan by giving us written notice at least 30 days before your next billing date. If your notice arrives later than that, the next month is billed and your change takes effect at the end of that month. We do not refund or credit partial months.
- Yearly care plans. Yearly plans cost 20% less than 12 monthly payments and are paid in advance for the full year. If you cancel within the first 30 days of a yearly term, we keep one month at the regular monthly price and refund the rest. After the first 30 days, yearly payments are not refundable and your plan runs to the end of the year. To stop a yearly plan from renewing, give us written notice at least 30 days before the renewal date. We email you a reminder at least 30 days before each yearly renewal.
- Upgrades. You can upgrade at any time. We start the new plan right away and charge the difference for the rest of the current billing period.
- Automatic payments. If you give us a card or other payment method for your care plan, you authorize us to charge it on each billing date until your plan ends under these terms. You must keep your payment details up to date. If a charge fails, we let you know and try again; you have 7 days to fix it before the late payment terms below apply.
- Invoices are due within 7 days. Overdue amounts bear interest at 1.5% per month (18% per year). If a payment is more than 14 days late we may pause changes and support. After 30 days we may take the site offline until the account is paid, and a $25 reactivation fee applies to turn it back on. You are responsible for reasonable collection costs, including collection agency and legal fees.
- Please contact us before disputing a charge with your bank. A chargeback or payment reversal made without contacting us first is treated as an unpaid invoice, plus a $25 administration fee, and we may suspend the service until it is resolved.
- Discounts and promotions, including the yearly discount and founding-client pricing, apply only while your account is paid on time.
- Founding-client pricing: the prices on our website apply to our first 30 clients who accept a Quote. After that, new clients pay the prices shown at the time they accept.
- We may change plan prices with 30 days' written notice. Changes never apply to a period you have already paid for.
4. Timeline and your responsibilities
- You provide accurate business information, such as hours, prices, address and services, and tell us when it changes. We publish what you give us and are not responsible for errors in it.
- You review and approve the preview before launch. You have 5 business days after we send it to ask for changes in writing. Your approval, a request to launch, or no reply within 5 business days means the site was delivered as agreed and the balance is due, except for fixes covered in section 11.
- Our timelines start when we receive the deposit and your content. Delays in sending content, feedback or payment extend the timeline.
- If you do not respond for 30 days during a project, we may close it. You keep what you have paid for so far, the deposit is not refunded, and restarting may need a new Quote.
- You keep any passwords we give you safe and tell us right away if you think someone else has access.
5. Your content and how you use the website
You confirm that you own or have permission to use every logo, photo, video, font, text, review and other material you send us or ask us to use ("Client Content"), and that publishing it does not break any law or anyone else's rights, including copyright, trademark, privacy and advertising laws.
You are responsible for your products, services, prices, offers, claims and reviews shown on the site, for any licences or permits your business needs, and for how your business uses the website and the information it collects.
We do not build or host websites for unlawful, hateful, sexually explicit, deceptive or infringing content, or for activity that we reasonably believe could harm people or expose us to legal risk. We may refuse, remove or disable such content, and may suspend the service if it is not fixed promptly.
Stock photos and fonts we supply are licensed for use on your website only, under their own licence terms.
6. Revisions and changes
Website setup includes 2 revision rounds on Launch, 5 on Growth and 10 on Pro. Business card design includes up to 3 revision rounds; printing is quoted and paid separately. Each plan includes the number of revision rounds before launch and the number of small changes per month shown on the pricing page. A small change is a text, price, hours or photo update that takes about 30 minutes or less. Larger work is quoted before we start. Unused changes do not roll over.
7. Domains, hosting and third-party services
Domain names are not included in the setup fee or care plan. We recommend the best available options for your business, and you choose one. The domain is registered in your name wherever the registrar allows, and you pay its registration and renewal fees at cost, either directly to the registrar or through us with no markup. If a domain expires because a renewal fee was not paid, we are not responsible for losing it.
Your website relies on third-party services such as domain registrars, hosting, databases, analytics, email, booking and payment providers, each with its own terms. We choose reputable providers, but we do not control them and are not responsible for their outages, data loss, security incidents, policy changes or price changes. We will help you work around them.
We aim to keep your site online at all times but do not guarantee uninterrupted or error-free service. We keep reasonable backups of the sites we host. You should keep your own copies of your content, photos and records.
8. Data on your website
If your site collects visitor information, such as form submissions or analytics, you are responsible for that information under privacy law, and we handle it only to provide our services and on your instructions. We keep it confidential, protect it with reasonable safeguards, do not sell it, and will tell you without unreasonable delay if we learn of a security breach affecting it.
9. Ownership and portfolio
Once you have paid setup in full, you own your Client Content and the design and content made specifically for your business. Until then, we keep all rights in the work. We keep ownership of our general code, templates, tools and know-how and may reuse them, and you receive a permanent licence to use them as part of your website.
We may show your website, name and logo in our portfolio and marketing unless you ask us in writing not to.
10. Cancellation and termination
You can end your care plan as described in section 3: after the first month for monthly plans, with written notice at least 30 days before your next billing date; for yearly plans, within the first 30 days of the term or by stopping the renewal with 30 days' notice. Notice must be sent by email to hello@neoxwebsites.ca and counts from the day we receive it. When the plan ends, and once any balance is paid, we send you your website files and help transfer your domain. Hosting under our account stops at the end of the last paid billing period.
We may end the agreement with 30 days' notice for any reason, or immediately if you seriously breach these terms, do not pay, use the site unlawfully, or are abusive to us. If we end it without cause, we refund any prepaid care plan fees for the unused period.
11. Fixes and warranty disclaimer
If something we built does not work as agreed, tell us within 30 days of launch and we fix it at no charge. This is your only remedy for defects in our work.
Apart from that promise, and to the extent the law allows, our services and the websites we build are provided "as is" and "as available", without any other warranty or condition, express or implied, including fitness for a particular purpose, merchantability, non-infringement, uninterrupted availability or compatibility with every device and browser.
12. No guaranteed results
We follow current best practice for speed, search engine optimisation (SEO), accessibility and analytics, but nobody controls search engines, social platforms or customer behaviour. We do not guarantee any ranking, traffic, number of calls, bookings, sales or other business result. Examples and figures on our website are illustrations, not promises.
13. Legal pages and compliance tools
We set up a cookie notice, consent-based analytics and template privacy, cookie and terms pages for your website, and we build to the Web Content Accessibility Guidelines (WCAG) 2.1 AA as a target. These are a starting point, not legal advice, and do not guarantee compliance with any law. You are responsible for making sure your website, policies and practices fit your business and the laws that apply to it, including after you or anyone else changes the site. We recommend having a lawyer review them.
14. Limitation of liability
To the extent the law allows:
- our total liability for all claims connected to our services or these terms, whether in contract, negligence or otherwise, is limited to the amount you paid us in the 6 months before the event that gave rise to the claim;
- we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data, business opportunities, goodwill or reputation, even if we were told they were possible;
- we are not liable for losses caused by Client Content, by changes made by you or anyone other than us, by third-party services, or by events outside our reasonable control.
Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud.
15. Indemnity
You agree to defend us and cover our reasonable losses, costs and legal fees if a third party, including a government body, makes a claim against us arising from your Client Content, your products or services, your breach of these terms, or your business's use of the website or of the information it collects.
16. Confidentiality
We keep your business information and logins confidential and use them only to provide our services. You keep our pricing, proposals and methods confidential where we mark them as confidential.
17. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as outages of internet or third-party services, cyberattacks, power failures, illness, natural disasters, government action or labour disputes.
18. Disputes
If you have a concern, email us first so we can try to fix it. If a dispute is not resolved within 30 days of written notice, either of us may propose mediation in British Columbia, with the cost shared equally. If mediation does not resolve it, the dispute will be decided by the Civil Resolution Tribunal of British Columbia, where it has jurisdiction, or otherwise by the courts of British Columbia. Each of us brings claims only on our own behalf, not as part of a class or representative action, to the extent the law allows. To the extent the law allows, any claim must be started within 1 year after it arose.
19. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.
20. General
- We are an independent contractor. Nothing in these terms creates a partnership, employment or agency relationship.
- We may use trusted subcontractors, and we remain responsible for their work. You may not transfer this agreement without our written consent.
- If any part of these terms is found unenforceable, that part is limited to the minimum extent needed and the rest stays in effect.
- If we do not enforce a right right away, we have not waived it.
- Sections that by their nature should continue after the agreement ends, including payment, ownership, warranty disclaimer, limitation of liability, indemnity, confidentiality and disputes, survive termination.
- These terms and your Quote are the entire agreement about our services and replace any earlier discussions.
- Notices may be sent by email to the address you gave us or to hello@neoxwebsites.ca.
21. Changes to these terms
We may update these terms. The version in effect when you accepted your Quote applies to that project. Updates for care plans take effect 30 days after we email you, and you may cancel before then if you do not agree.
22. Contact
Questions about these terms: hello@neoxwebsites.ca. Neox Websites, Metro Vancouver, British Columbia, Canada.
Refund Policy
We want every client to be happy with their website. This policy explains when money is refunded. It is part of our Terms of Service.

- Before design work starts: cancel and we refund your full deposit.
- After design work starts: the 50% deposit is not refundable, because the time has been spent. You do not owe the second 50%.

Monthly care plans
- Your first month is paid in full and is not refundable.
- After that, to cancel or change your plan, email us at least 30 days before your next billing date. You are not charged for months after your plan ends.
- If you tell us later than 30 days before your billing date, the next month is charged and your plan ends after it.
- We do not refund partial months.
Yearly care plans (20% off)
- Within the first 30 days of a yearly term: cancel and we refund your yearly payment minus one month at the regular monthly price.
- After the first 30 days: yearly payments are not refundable and your plan runs until the end of the year.
- To stop a yearly plan from renewing, email us at least 30 days before the renewal date. We send a reminder at least 30 days before each renewal.
If we end the service
If we end your care plan without cause, we refund the unused part of any period you have already paid for.
Add-ons and third-party costs
Add-ons are refundable until we start the work. Domain fees are paid separately at cost. Domain registrations and other third-party purchases made for you cannot be refunded once bought.
How to ask
Email hello@neoxwebsites.ca with your business name. We reply within 2 business days and send approved refunds to the original payment method within 10 business days. This policy does not limit any rights you have under the law.
Privacy Policy
Neox Websites respects your privacy. We follow British Columbia's Personal Information Protection Act (PIPA) and, where it applies, Canada's Personal Information Protection and Electronic Documents Act (PIPEDA). This policy explains what we collect on neoxwebsites.ca and when you work with us.
What we collect
- Quote form: your name, business name, email, phone (optional), the plan you are interested in and your message, plus the date and version of the terms you agreed to and whether you opted in to emails.
- Clients: the business information, content and logins you share so we can build and run your site, and billing records.
- Website analytics: only if you accept it, anonymous counts of page views and button clicks, plus your device type (phone, tablet or computer) and the website that sent you here. We use a random visit ID that is deleted when you close the tab. We do not use cookies for this, store your IP address, identify you or follow you to other sites.
- Emails you send us: the content of your messages and your contact details.
Our hosting provider may briefly process technical information such as IP addresses to deliver the site and protect it from attacks. We do not use it to identify you.
Why we use it
To answer your enquiry, prepare quotes, deliver and support our services, send invoices, keep records of agreements, protect our legal rights, and improve our website. We only send marketing emails if you tick the box agreeing to receive them, as required by Canada's Anti-Spam Legislation (CASL). Every marketing email has an unsubscribe link.
Consent
By sending the quote form or becoming a client, you consent to the uses above. Analytics and marketing emails are optional and need your separate consent. You can withdraw consent at any time, though we may then be unable to provide some services.
Who we share it with
We never sell or rent your information. We share it only with service providers that help us run our business, under confidentiality obligations, such as Supabase (database, hosted in Canada), Cloudflare (website hosting and security), our email provider and our payment processor. Some providers may process data outside Canada, including in the United States, where it may be accessed by authorities under local laws. We may also disclose information when the law requires it or to protect our legal rights.
How long we keep it
Enquiries that do not become projects are deleted within 12 months. Analytics are kept for up to 24 months. Client agreements and billing records are kept for 6 years to meet Canadian tax and legal requirements, then deleted.
How we protect it
Our site is served over HTTPS. Form submissions are stored in a database that visitors can add to but not read, and only our signed-in administrator can view them. We limit access to client information to what is needed to do the work. No system is perfectly secure, but if a breach creates a real risk of significant harm to you, we will notify you and the Privacy Commissioner as the law requires.
Your rights
You can ask to see, correct or delete the personal information we hold about you, or withdraw consent, by emailing our privacy contact at hello@neoxwebsites.ca. We reply within 30 days. If you are not satisfied, you can contact the Office of the Information and Privacy Commissioner for British Columbia or the Office of the Privacy Commissioner of Canada.
Children
Our website and services are for businesses and are not directed to children. We do not knowingly collect information from anyone under 16.
Changes
We may update this policy and will change the effective date above. Important changes will be highlighted on this page.
Website Terms of Use
These terms apply to anyone using neoxwebsites.ca. By using this website you agree to them. If you do not agree, please do not use the site. Our Terms of Service apply separately when you hire us.
Information on this site
The content is general information about our services and may change without notice. It is not legal, financial or professional advice. Prices shown are current offers and may contain errors, which we may correct. The written Quote you accept is what applies to your project.
Examples and results
Portfolio work belongs to its respective owners and is shown as an example of our work. Concept and demo projects, such as Bricklight Pizza Co., are fictional businesses made to show our skills, and are labelled as such. Any reviews, figures or results shown in them are samples, not real customer statements. Results differ for every business and nothing on this site is a promise of any outcome.
Intellectual property
All text, graphics, code, the Neox name and the raven logo belong to Neox Websites or are used with permission. You may view and share pages for personal or business evaluation, but you may not copy, resell or reuse our designs, code or content without written permission.
Acceptable use
You agree not to misuse the site, including by sending false, spam or automated form submissions, impersonating anyone, trying to access our systems or data without permission, interfering with security or performance, scraping content at scale, or uploading anything unlawful or harmful.
Links to other websites
Links to other websites are provided for convenience. We do not control and are not responsible for their content, products or privacy practices.
Disclaimer and limitation of liability
To the extent the law allows, this website is provided "as is" and "as available", without warranties of any kind, and we are not liable for any direct or indirect loss arising from its use or from reliance on its content, or from it being unavailable.
Indemnity
If you misuse the site or break these terms, you agree to cover the reasonable costs, including legal fees, of any claim that results.
Credits and licences
The Neox name, raven logo, site design and text are original work by Neox Websites. Fonts: Unbounded and Manrope, used under the SIL Open Font License. Icons: Phosphor Icons, used under the MIT License. Photos in the Bricklight Pizza demo were generated with AI tools for this demo and do not show a real business. Client screenshots are shown with the client's permission.
Governing law and changes
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, and disputes go to the courts of British Columbia. We may update these terms by posting a new version here. If any part is unenforceable, the rest stays in effect.
Accessibility
We aim for this website, and the websites we build, to meet the Web Content Accessibility Guidelines (WCAG) 2.1 at level AA. That includes readable colour contrast, keyboard navigation with visible focus, labelled form fields and buttons, text alternatives for images, and reduced motion for people who turn it off in their device settings.
How we check: before launch and after major changes we run automated tests (axe), check colour contrast, and use the site with a keyboard only and on a phone. Automated tools cannot catch everything, so we also welcome feedback.
Some content, such as third-party maps or booking widgets, may not fully meet these guidelines. If something on this site is hard to use, email hello@neoxwebsites.ca and we will fix it or get you the information another way, usually within 5 business days.
